DUI Penalties

Suspension Times (Within 10 years)

While the laws surrounding DUI offenses vary from state to state, Kentucky has strict laws on how long your license will be suspended after an arrest. The Kentucky Transportation Cabinet (KYTC) administers the following suspension times.

1st Offense

  • 90-day Alcohol or Substance Abuse Treatment Program

  • 6-month License Suspension

2nd Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 18-month License Suspension

3rd Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 36-month License Suspension

4th Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 60-month License Suspension

Commercial Driver’s License

If you are convicted of driving under the influence of alcohol or drugs, then your commercial driver’s license will be suspended for one year. During this time, you cannot drive any vehicle that requires a commercial license until your conviction has been cleared from your record. You must also pay a $50 fee to reinstate your CDL.

Before getting a valid CDL permit after the suspension period, you will have to pass vision, written and pertinent skill tests, in addition to a 14-day holding period for the permit.
