From DUI to Traffic Violations, We Can Help

Mudd Legal Group provides legal representation for clients in Kentucky who have been charged with driving under the influence or other traffic violations. Our team of highly experienced attorneys can help you navigate the complex legal process of your case.

Driving Under the Influence (DUI)

Driving under the influence is one of the most common reasons for traffic violations, and it also presents one of the biggest risks to drivers. DUI offenders can face steep fines, community service, license revocations, and even jail time for their actions.

In Kentucky, the law states that anyone under drug influence or with a blood alcohol content (BAC) of .08% or higher is considered to be driving under the influence. A DUI may be charged as a misdemeanor or felony, depending on the circumstances of the case and the prior criminal record of the defendant.

The consequences of a DUI conviction are severe and often life-altering in nature. Mudd Legal Group provides expert legal counsel for DUI and traffic violations throughout the Louisville area. We know that a conviction can have lasting effects on your life, and we want to help you find the best way forward.

DUI Penalties

DUI charges can carry serious consequences if not handled correctly. If you were arrested for driving under the influence (DUI), here’s an overview of the applicable suspension times and penalties under a commercial driver’s license.

Suspension Times (Within 10 years)

While the laws surrounding DUI offenses vary from state to state, Kentucky has strict laws on how long your license will be suspended after an arrest. The Kentucky Transportation Cabinet (KYTC) administers the following suspension times.

1st Offense

  • 90-day Alcohol or Substance Abuse Treatment Program

  • 6-month License Suspension

2nd Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 18-month License Suspension

3rd Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 36-month License Suspension

4th Offense

  • 1-Year Alcohol or Substance Abuse Treatment

  • 60-month License Suspension

Commercial Driver’s License

If you are convicted of driving under the influence of alcohol or drugs, then your commercial driver’s license will be suspended for one year. During this time, you cannot drive any vehicle that requires a commercial license until your conviction has been cleared from your record. You must also pay a $50 fee to reinstate your CDL.

Before getting a valid CDL permit after the suspension period, you will have to pass vision, written and pertinent skill tests, in addition to a 14-day holding period for the permit.

Traffic Violations

Traffic violations are a common cause of traffic tickets, and can have a significant impact on your driving record. These offenses can result in points on your license, fines, and higher insurance rates.

If you have been cited for a traffic violation, you should contact a Louisville traffic attorney immediately. You may be able to have the charge dismissed or reduced and avoid points on your license. At Mudd Legal group, we are here to help, whether it be a first-time offense or a repeat offense.

Common Traffic Offenses

In Louisville, KY & surrounding counties, traffic violations are serious matters that can have lasting effects on your driving record and your insurance rates. Here are some common traffic offenses.

  • Speeding

  • Driving under the influence (DUI)

  • Reckless driving

  • Non-compliance with permit requirements

  • Failing to yield right of way

  • Stop Violation

  • Fleeing and evading

If you have been charged with a traffic violation in Kentucky, you are at risk of losing your driving privileges. The law, through the Kentucky Point System, provides that a person’s privilege to operate a motor vehicle will be suspended if he/she receives 12 points or 7 points (for underaged drivers) within two years. However, an individual is allowed to meet with a hearing officer before any possible suspension takes effect.

Consequences of Multiple Offenses

If you are convicted of more than one offense in Kentucky, there may be additional consequences depending on the circumstances surrounding each conviction. For example, if you have multiple convictions for driving under the influence (DUI), then you may face enhanced penalties.

The penalties for multiple offenses may include:

  • Increased penalties for subsequent offenses

  • Higher fines

  • Mandatory jail time for repeat offenders or community service

  • Ignition interlock devices are required for all new vehicles purchased for at least one year after sentencing (in a DUI case)

If you are a repeat offender or have multiple charges pending against you, you must hire an attorney who is experienced in handling these cases. At Mudd Legal Group we understand how these cases work and will help you through every step of the way. We will work hard to protect your rights and create an effective legal strategy for your case.
